TERMS AND CONDITIONS OF GALAR GDAŃSKI PASSENGER CRUISES

These terms and conditions take effect on 5 October 2026. They apply to tourist passenger cruises on wooden galar-type boats offered under the Galar Gdański brand. Bookings made before that date are governed by the terms accepted at the time of purchase.

1. Operator and cruise starting point

1. The cruises are operated by Fundacja Galar Gdański, with its registered office at ul. Szafarnia 11 lok. F8, 80-755 Gdańsk, entered in the Polish National Court Register (Krajowy Rejestr Sądowy) under number KRS 0000716387, NIP 9571101331, REGON 369372856 (hereinafter: the “Operator”).
2. The Galar Gdański landing stage is located at ul. Dokowa 1/G, 80-863 Gdańsk. The cruise starts and ends at the place indicated in the offer or by the staff.
3. Tickets are available through the website www.galar.org, at the Yard.Cafe bar during its opening hours and, where the relevant offer is available there, through external sellers.

2. Terms and conclusion of the contract

4. The terms and conditions are made available before a ticket is purchased on the website www.galar.org and at the point of sale at the landing stage. The Operator also makes them available before entry to the landing stage. Where a ticket is sold through an intermediary, the purchase conditions and information about the terms and conditions should be made available by the seller before purchase.
5. The customer is obliged to read the terms and conditions before purchasing a ticket, and each passenger before boarding. Ignorance of the safety rules does not release anyone from the obligation to comply with them. In case of doubt, the passenger should ask the staff before boarding. By making a purchase from the Operator, the customer accepts the terms and conditions made available to them before the contract is concluded. The passenger is obliged to comply with the safety rules and the instructions of the skipper.
6. Information on the price, date and time, expected duration and route of the cruise is provided in the offer at the time of purchase. In the event of a difference between the general description and the information concerning a specific cruise, the information given for that cruise prevails, taking into account changes permitted by these terms and conditions.

3. Tickets, bookings and punctuality

7. The maximum number of persons on the boat is 12 passengers and 2 crew members. Every person, including an infant, counts towards the passenger limit. The limits permitted in the documents of the given vessel must not be exceeded.
8. A group larger than the limit of one boat will be split between the appropriate number of boats. Where separate bookings are made for the same time, the Operator may combine passengers on boats. Persons from a single booking may be split between boats if required by the capacity limit or by the organisation of a safe cruise. Purchasing tickets for the same time does not guarantee a shared boat unless the Operator has confirmed this in writing.
9. Passengers should arrive at the check-in point at least 15 minutes before the scheduled start of the cruise and have their tickets ready for inspection. The boat may depart at the scheduled time. If a passenger is late or fails to show up, the Operator is not obliged to delay the cruise, provide another date or refund the ticket price, subject to mandatory legal provisions.
10. A customer who bought a ticket directly through the system at www.galar.org may cancel the booking or change its date or time free of charge no later than 24 hours before the scheduled start of the cruise. In the case of cancellation within that period, a full refund of the ticket price is due. Cancellation or change can be made independently in the booking system or, if the system does not offer that option, reported to hello@galar.org. The Operator orders the refund without undue delay after the booking has been effectively cancelled. The refund is made using the original payment method, unless another method has been agreed with the customer at no additional cost to the customer. The time it takes for the funds to be credited depends on the payment provider and the customer’s bank. After the 24-hour deadline has passed, free change or cancellation on the terms set out in this item is no longer available. The rules on cancellation, changing a booking and processing refunds for tickets bought from intermediaries are set by the seller, without prejudice to the customer’s rights against the Operator concerning the performance of the cruise.
11. A consumer does not have the statutory 14-day right of withdrawal from a distance contract concerning a passenger cruise. In the case of a passenger transport service, this follows from Article 3(1)(4) of the Polish Act of 30 May 2014 on Consumer Rights. In the case of leisure services, where the contract specifies the day or period of their provision, Article 38(1)(12) of that Act applies. This does not exclude the rules on free change or cancellation set out in item 10 or any other rights granted by the Operator or arising from legal provisions.
12. It is prohibited to offer or resell tickets for profit without the Operator’s consent. The Operator may refuse to honour a ticket which it has reasonable grounds to believe is forged, cancelled, previously used or obtained through abuse. Where possible, the Operator will allow the purchaser to demonstrate that they are entitled to use the ticket. A mere suspicion of resale does not deprive the customer of rights arising from legal provisions.

4. Safety and conduct on board

13. The skipper commands the vessel and makes decisions concerning safety. Passengers must promptly and precisely follow the skipper’s instructions and the crew’s instructions given on matters of safety, boarding, disembarking and the organisation of the cruise. Taking part in the cruise requires physical fitness allowing safe boarding and disembarking.
14. While the boat is under way, manoeuvring, passing other vessels and passing under bridges and footbridges, passengers must not:

• stand up or move around the boat without the skipper’s consent;
• change seats or swap seats without the skipper’s consent;
• lean over the side, put their hands in the water or raise their arms or objects above their heads;
• hold on to bridges, footbridges, other vessels or the boat’s fenders;
• hinder the skipper in steering the boat or block the skipper’s field of view.

15. Where required by the water level or the clearance under a structure, passengers must, on the skipper’s instruction, lower their heads and remain in their seats until the structure has been safely passed.
16. Each boat carries the rescue equipment required for the given vessel. The boat carries life jackets for all passengers, available in different sizes. Persons who have reached the age of 18 decide for themselves whether to wear a life jacket during the cruise and are responsible for their decision. Every person under the age of 18 is obliged to wear a properly fitted life jacket correctly throughout the cruise. Irrespective of the above rules, the skipper may order any passenger to put on a life jacket if required by the conditions of the cruise or for safety reasons. Passengers are obliged to comply with such instructions. The guardian of a minor is responsible for cooperating in selecting and correctly fitting the minor’s life jacket.
17. The boat has an open deck. Passengers should dress appropriately for the weather and conditions on the water. The Operator does not guarantee that the cruise will take place in conditions sheltered from rain, wind, sun or low temperatures.
18. It is prohibited to throw any objects or waste into the water. At the landing stage, the designated containers must be used and waste must be sorted.
19. It is not permitted to board or remain on board in a condition that may endanger safety, hinder the conduct of the cruise or infringe the safety and comfort of other persons, in particular under the influence of alcohol or intoxicating substances. The skipper may refuse boarding or instruct the passenger to disembark at a safe place. If the cause is the passenger’s behaviour or condition, the Operator may refuse to refund the price for the part of the Service not performed. Consuming alcohol on board is permitted only with the skipper’s prior, express consent; the consent may be withdrawn.
20. A passenger who by their behaviour endangers safety, damages property, harasses other persons or fails to follow the skipper’s instructions may be asked to change their behaviour or to leave the boat at a place and time chosen for safety reasons. The Operator may interrupt the cruise if continuing it poses a danger. The incident will be recorded by the crew.

5. Minors and animals

21. A person under the age of 18 may take part in a cruise only under the direct care of a parent or an adult guardian. The guardian looks after the minor throughout the stay at the landing stage and the cruise, and is responsible for the minor following safety instructions and for damage caused through the minor’s fault, to the extent provided by law.
22. A calm pet may be taken on board if it does not endanger passengers, the crew or the animal itself and does not hinder a safe cruise. A dog must be kept on a lead and wear a muzzle. The obligation to keep the dog on a lead and muzzled does not apply to assistance dogs, including guide dogs, accompanying persons with disabilities on the terms set out in applicable legal provisions. The owner or keeper of the animal exercises constant control over it, cleans up after it and is liable for any damage caused on the terms provided by law. The skipper may refuse to carry an animal or discontinue its carriage if the animal’s behaviour poses a danger, taking into account the statutory rights of persons using assistance dogs.

6. Luggage, food, drinks and facilities

23. Due to the limited space and the need to keep passageways and evacuation routes clear, bicycles and items that hinder movement or may endanger safety are not accepted on board. There are bicycle racks at the landing stage. The possibility of leaving larger luggage at Yard.Cafe must be agreed with the staff before handing it over. The Operator is not liable for luggage that the staff have not taken into their care. Liability for items taken into care is determined by applicable legal provisions.
24. As a rule, it is not permitted to bring or consume your own drinks and snacks on board. Products purchased at Yard.Cafe are allowed. The ban does not cover medicines, infant food or products necessary for health reasons. Alcohol purchased at Yard.Cafe may be brought on board and consumed only with the skipper’s prior consent.
25. There are no toilets on the boats. Passengers may use the free toilets at the landing stage before or after the cruise.
26. Smoking tobacco, tobacco products, e-cigarettes and similar devices is prohibited on board and under the landing stage’s tent. Smoking is permitted only in the designated place in the open area of the landing stage.

7. Changes to and cancellation of the cruise

27. The Operator may cancel a cruise, delay its start, shorten it, change its route or interrupt it when required by the safety of passengers or crew, the technical condition of the vessel, an instruction from the competent authorities, the closure or restriction of the waterway or other circumstances beyond the Operator’s reasonable control. Such circumstances may include, among others, a thunderstorm with lightning, strong or gusty wind, high water levels, heavy precipitation, a breakdown, a blockage or works on the waterway.
28. Where possible, the Operator will inform the customer of a change or cancellation before the cruise, using the contact details provided at the time of purchase. If a cruise is cancelled, the customer may choose a refund of the price for the service not performed or a free change of date. In the case of a ticket bought from an intermediary, the refund is processed through the seller or another entity competent under the contract and legal provisions. If a cruise is interrupted for reasons on the Operator’s side, the customer is entitled to a proportionate refund of the price for the part of the service not performed. In other cases of interruption of the cruise, the customer retains the rights arising from applicable legal provisions.
29. The route and duration of the cruise may change for safety reasons, on the instructions of the competent authorities or due to conditions on the waterway. The Operator will inform passengers of a significant change when possible. If the change means that a significant part of the purchased service is not performed, the customer retains the rights arising from legal provisions. A minor organisational or route change that does not alter the essential nature of the cruise does not in itself automatically give a right to a refund of the entire price.

8. Complaints and purchases through intermediaries

30. Complaints concerning the cruise may be submitted to hello@galar.org or by telephone on +48 500 609 999. For efficient handling, it is advisable to provide the booking number, the date and time of the cruise, a description of the incident and the desired way of resolving the matter. The request to report as soon as possible serves to verify the circumstances and does not limit the statutory time limits or the customer’s rights. The Operator responds to a complaint within 14 days of receiving it. The response is sent to the customer by email to the address they have provided. If the customer does not provide an email address, the response is delivered on paper or on another agreed durable medium. In the case of a consumer’s complaint, failure to respond within that period means that the complaint is deemed accepted, unless separate legal provisions provide otherwise.
31. For a ticket bought from an intermediary, the customer should address matters concerning payment, cancellation or refunds to the seller, in accordance with that seller’s purchase conditions. Complaints concerning the performance of the cruise itself may be submitted to the Operator. This provision does not exclude the customer’s rights against the seller or the Operator’s liability for obligations arising for it from legal provisions.

9. Liability

32. The passenger should exercise caution, comply with the terms and conditions and the skipper’s instructions, and not take actions that endanger people, the boat or the infrastructure. The passenger is liable for damage caused intentionally or as a result of a culpable breach of the rules, on the terms provided by law. The guardian is responsible for supervising the minor in accordance with legal provisions.
33. The Operator is not liable for items left unattended on the boat or for luggage that it has not taken into its care. This provision does not exclude the Operator’s liability arising from applicable legal provisions, including for damage caused by culpable acts or omissions of the Operator or the crew.

10. Personal data and image

34. The controller of personal data related to bookings, the performance of the cruise and complaints is Fundacja Galar Gdański. Contact on data matters: hello@galar.org. Detailed information on the purposes and legal bases of processing, retention periods, recipients of data and the rights of individuals is made available, before the data is provided, in a separate information notice on the Operator’s website and at the point of sale.
35. Video surveillance operated at the landing stage serves security and property protection purposes. The monitored area is marked.

11. Final provisions

36. Matters not regulated by these terms and conditions are governed by Polish law. Any disputes are resolved by the courts competent under applicable legal provisions; the terms and conditions do not impose on the consumer a territorially competent court.
37. The current version of the terms and conditions is available at www.galar.org, at the point of sale and before entry to the landing stage. The Operator makes the terms and conditions available in a form that allows them to be read before a ticket is purchased.
